Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls and struck by hazards: (a)Wayne's Electric at 6155 Parkway Drive, Commerce City, CO 80022: On November 5, 2003, the employer did not ensure that an electrician riding in the bed of an aerial lift truck was using a seatbelt. The employer drove the truck from north side of the excavation site to the south side over newly excavated soil. Condition exposed employee to the hazards of falls and of being struck by moving vehicles. Abatement Note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter"). Among other methods, a feasible and acceptable abatement method included requiring the employee to ride in the cab of the pickup, or requiring him to walkaround the excavation site.
