Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees as employees were exposed to: crushing injuries as a result being struck by falling and or swinging tree trunks while felling trees using chainsaws in combination with cables and winching systems. On or about April 1, 2003, a single loop choker cable was placed around the bottom of two leaning tree trunks. A rapid swing of one tree trunk occurred when the winch was engaged. An employee in the work area/danger zone was struck by the tree. Among other methods, one means of correcting this hazard is to develop and implement safe work procedures as detailed in American National Standards Institute for Tree Care Operations, ANSI Z133.1-1988 Pruning, Trimming, Repairing, Maintaining and Removing Trees, and Cutting Brush - Safety Requirements. Paragraph 8.5 Felling requires careful consideration of the tree and surrounding area prior to beginning any felling operation. Shape of tree, lean of tree, location of other persons, clearing of work area, escape route planning and removal of all workers not directly involved in the operation [of dropping the tree(s) via winching system] shall be kept clear of the work area. The work area is recognized by OSHA in the Logging Operations standard 29 CFR 1910.266(d)(6)(ii) as at least two (2) tree lengths of the tree(s) being felled.
