Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which was free from recognized hazards that caused, or was likely to cause, death or serious physical harm to employees in that employees were exposed to: On April 16, 2003, at the Abrams Creek Project in Brook Park, OH., an employee was observed working from the elevated bucket of a hydraulic excavator. The employee was in the process of stripping off forms approximately 15 feet high. He was exposed to a fall hazard that could have caused injuries from being crushed, struck, and/or falling through inadvertent movement of the bucket. Among other feasible and acceptable methods to correct this hazard, the employer could have used an aerial lift, ladder, or scaffold to reach the elevated work area..
