Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of amputation and fracture:
a) Press Area - The foot contol on the Diacro mechanical press brake,
number 95, was not
protected from falling, moving objects or unintended operation.
b) Press Brake Area - The foot control on three Diacro mechanical press
brakes, numbers 7, 18
and 19, were not protected from falling, moving objects or unintended
operation.
Among other methods, one feasible and useful method to correct this hazard
is to follow ANSI
B11.3 - 2002, Section 6.11.3.1 which states when provided, foot controls
shall be protected
from falling or moving objects or from unintended actuation.
(1) Install a guard around the foot control to prevent accidental
actuation.
Abatement documentation is required for this item in accordance with the
requirements of
29 CFR 1903.19(d).
