Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On April 21, 2003 Elliot Construction Corp. did not barricade and permitted employees to access areas within the swing radius of the rear of the rotating superstructure of a Kobelco SK 300 LC hydraulic excavator. This activity exposed employees to a struck-by hazard and the hazard of being crushed between the excavator tracks and the rotating superstructure. Among other feasible and acceptable abatement menthols to correct this hazard include barricading the area to prevent employee entry. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
