North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to fall hazards:
a)jobsite, platform arranged upon a rough terrain
forklift's forks used to elevate personnel did not have
a positive means of restraint or securement to prevent
the platform from becoming dislodged from the forks.
b)jobsite, personnel platform was used with a rough terrain
forklift to elevate personnel and the platform's
guardrail system included a chain used as a guardrail top
rail which measured approximately eighteen inches above
the work platform and a chain used as a guardrail midrail
which measured approximately two inches above the work
platform.
Note: Among other possible means, one feasible means of
abatement is the use a platform with a chain loped around a
member of the platform or attached to the platform and loped
around a member upon the forklift's mast in a manner to
prevent dislodgement and the use of a platform with a standard
guardrail system (top rail measuring 39 to 45 inches above the
platform and a midrail installed at a height midway between
the top edge of the guardrail system and the platform) at all
