Section 5 (a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing or traumatic injuries due to failure of machine
components:
On or about 7/22/03 an employee operating Barko Loader Model 80 BC Serial
BP16095
mounted on Mack truck Connecticut registration J79642 was injured when the
frame head
supporting the boom failed. In addition, a tire on the right rear side of
the Mack Truck was
damaged.
Among other methods one feasible and acceptable abatement method to
correct the hazard is to
develop a formal documented inspection program and preventive maintenance
program in
accordance with the Barko Operator's Manual. The inspection program should
include a daily
inspection of critical components of the loader. The inspection program
should also include a
periodic complete inspection of the loader. The periodic inspection should
include steam cleaning
and an inspection of the entire loader for stress, wear, cracks, damage
and loose parts.  All new
structural repairs made should be done under the direction of a qualified
engineer.  All structural
repairs that were previously made should certified by a qualified
engineer. A formal preventive
maintenance program should be implemented in accordance with the Barko
Operator's Manual
to ensure that lubrication, greasing, and other periodic maintenance is
done.
Replace the defective tire on the truck.
