Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards from automotive lifts: Garage: Employees use hydraulically driven mechanical lifts for vehicle repair and maintenance. Including but not limited to the following instances, employees were exposed to crushing, falling and strain hazards created by the automotive lifts due to component failures. A.Hydraulic Lift, Right Front of Bay: No mechanical safety was provided to prevent the lift from dropping or turning. The lift had not been removed from service until appropriate repairs could be made by qualified lift service personnel. B.Hydraulic Lift, Left Rear Corner of Bay: A safety catch on one post was damaged and the lift rocked when lowered. The lift had not been removed from service until appropriate repairs could be made by qualified lift service personnel. C.Lift Operator Training was not documented as required by ALI ALOIM-1994 Section 4.3. D.The Employer did not institute a preventative maintenance procedure to ensure the continued safe operation of each lift as required by ALI ALOIM-1994 6.1.1. E.The employer did not ensure that each lift operator followed the recommended inspection procedures of the lift manufacture and at a minimum noted the points required on a daily basis by ALI ALOIM 4.4.4. Feasible abatement, among others, would be to have the lifts insepcted and repaired by a qualified lift service personal then implement ANSI (American National Standards Institute) B 153.1-1981 Safety Requirements fro the Construction, Care and use of Automotive Lifts, or the Automotive Lift Institute ALOIM-1994 Safety Requirements fro Operation, Inspection and Maintenance Standard for Automotive Lifts. Ensure that operators are trained to perform daily inspections, recognize hazards and take appropriate action to remove the lift from service until repairs can be made by qualified personnel.
