Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard: 105 Sunset Ridge: On 08/05/04 an employee was struck on the head and injured while mixing cement with a concrete & gunite mixer. The weld securing the mixing auger lift cylinder to the mixing auger failed allowing the mixing auger to free fall and strike the employee's unprotected head. Among other methods, feasible and acceptable abatement methods to correct this hazard would be to: A.Follow the manufacturers service manual (page 5): "Inspect the entire assembly for cracks, broken welds or other structural problems-repair as needed" on a monthly basis. B.Adhere to the manufacturers service manual warning label (page 25, also posted on vehicle): "Danger Stand Clear Of Mixing Auger Death Or Serious Injury May Result." PLEASE NOTE: CERTIFICATION AND DOCUMENTATION ABATEMENT IS REQUIRED FOR THIS VIOLATION.
