Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from recognized
hazards that were causing or likely to cause death or serious physical
harm to employees in that an employee
(spotter) was exposed to the hazard of being struck by a truck, as the
driver of the truck was unable to clearly
see the employee:
A feasible and useful means of abatement includes, but is not limited to
the following actions:  1) Make sure
employees are wearing "High Visibility Clothing" or a
reflective/retroreflective Traffic Vest as recommended
by the American National Standard Institute  2) Reinstitute a means of
communication between the spotter and
the equipment operator to ascertain the position of the spotter ie. radio!
3) Train employees to recognize the
importance of wearing high-visibility clothing and reflective vests and
enforce company safety rules that
require employees to wear such clothing.
OR IN THE ALTERNATIVE:
29 CFR 1926.95(a):   Protective equipment, including personal protective
equipment for eyes, face, head and
extremities, protective clothing, respiratory devices, and protective
shields and barriers, were not provided,
used and maintained in a sanitary and reliable condition.
a)Location: In front of Lot 112 Rouse Run Circle.  An employee was struck
by a Ford dump truck
(68,800 lbs) as he was directing the truck back into the dump area.  The
driver of the truck lost view
of the employee.  The employee was not wearing any "high visibility"
clothing such as a bright
orange, green, yellow or a reflective material.
Violation occurred on or about 7/28/2003
