Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of not wearing a seatbelt while operating a forklift which could result in crushing injuries: (A) Dry good receiving area: On or about April 15, 2003 and at times prior thereto employees operating forklift #26 were not required to wear the seatbelt as half of it was missing. (B) The #18 Caterpillar forklift, model #EP18T-36A, SN6MM01795 was not equipped with a seatbelt. (C) Plant #2: #9 forklift was not equipped with a seatbelt. (D) Plant #2: #11 forklift was not equipped with a seatbelt. Note: Abatement certification required for this item.
