Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of operating powered industrial trucks: (a)Warehouse: On or about July 22, 2003, and at times prior thereto, powered industrial truck operators were allowed to operate forklifts, including but not limited to an electric Yale/Chase industrial truck (Company # F13, Serial Number A807N04395T, 10-31-96 ), without using the seatbelt provided by the manufacturer. On #F13, half of the seatbelt had been removed. This condition exposed the operators to crushing injuries in the event over a tip-over or a collision. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that operators of powered industrial trucks utilize a complete operator restraint system/seatbelt provided by the manufacturer, as required by ANSI/ASME B56.1a -1989 Safety Standard for Powered Industrial Trucks, Paragraph 5.3.19. Forklifts manufactured prior to 1989 may not have been equipped with a seatbelt. The hazard of a tip-over remains the same if not greater due to the age of the lift truck. Where a seatbelt has not been provided on an earlier model lift truck, contact the forklift manufacturer or local distributor to obtain a retrofit seatbelt (may require the purchase of a different seat) and require the use of seatbelts when operating forklifts throughout the establishment. Note: Abatement certification required for this item.
