Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees riding in the scoop of a skid steer were exposed to the hazard of being crushed by it: a) Near Bridgetower Subdivision, on or about 9 OCT 03, an employee was observed riding in the scoop of a New Holland LS 180 skid steer that was in transit. Note: Abatement certification required for this item. Additional note: One feasible means of abatement, among others, is to not permit riders on any vehicles that lack seat belts.
