Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were transported in a personal platform not designed by a qualified engineer or qualified person competent in structural design: (A)Job Site: On February 6, 2004, and at times prior thereto, an engineer or competent person had not certified the structural design and capacity of the personnel platform used during a vehicle recovery operation. Note: Abatement certification required for this item. ABATEMENT NOTE: One feasible and acceptable method of abatement, amongst others would be to follow personnel platform design regulations set forth in 29 CFR 1926.550(g)(4), Crane or derrick suspended personnel platforms.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that modifications or additions which affected the capacity or safe operation of the equipment were made without the manufacturer's written approval: (A)Job Site: On February 6, 2004, and at times prior thereto, the manufacturer of the 100-Ton P&H series crane was not consulted prior to exchanging the specified one-inch wire rope for one-half inch wire rope. Note: Abatement certification required for this item. ABATEMENT NOTE: One feasible and acceptable method of abatement, amongst others would be to follow the regulations set forth in 29 CFR 1926.550(a)(16), Crane or derrick general requirements. Modifications which affect the capacity or safe operations of the equipment require manufacturer's written approval.
