employees were exposed to hazard of being backed over by motor vehicles
having a
restricted view to the rear:
(a)U.S. Interstate 90 in the vicinity of mile marker # 46: On or about May
24,
2004, and at times prior thereto, employees were exposed to the hazard of
being backed over by the Kenworth water truck (vin # 2576393/Montana
License # S10960), where adequate measures were not taken to warn
personnel on the ground that the equipment was backing up or to ensure that
equipment could be backed up safely.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to install and properly maintain a functioning back up alarm or
use a
observer/signal person(s) to signal to the operator when it is safe to
back
up.

this

(2)Abatement certification for this item will require an inspection of all
trucks
and equipment with similar hazards and taking corrective action if
necessary,
where back up alarms are used in lieu of observers/signal person(s).

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to hazard of a vehicle with defective brakes or
inadequate
braking/stopping capabilities:
(a)U.S. Interstate 90 in the vicinity of mile marker # 46: On or about May
24,
2004, and at times prior thereto, operator and/or employees were exposed to
the hazard of defective brakes on the Kenworth water truck (vin #
2576393/Montana License # S10960), the brakes had evidence of oil seepage
into or out of the brake lining/drum interface area.  Furthermore, there
was
evidence that further contamination will continue onto the brake linings
and
within the brake drum.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to is to follow the US Department of Transportation regulations
promulgated
by the Federal Motor Carrier Safety Administration in 49 CFR Part 393
and/or the
North American Uniform Driver Out-of-Service Criteria for inspection,
repairing and
removing unsafe motor vehicles from the work site until properly repaired.

Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to follow the US Department of Transportation regulations
promulgated by
the Federal Motor Carrier Safety Administration in 49 CFR Part 393.93
requiring
every truck and truck tractor manufactured on or after July 1, 1971 to have
appropriate seat belt assemblies which conform to the requirements
specified in the
Federal Motor Safety Standard No. 208 (571.208).
