Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of a fall : (a)Job site: on May 25, 2004 an employee was exposed to a fall of 20 feet while accessing an awning from the top of an extension ladder that not only did not reach the upper landing surface but also was not tied down to prevent slipping. Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with 29 CFR 1926.1053 (b) (1) which requires that ladder side rails extend at least 3 feet above the upper landing surface to which the ladder is used to gain access. Note: Abatement certification required for this item.
