Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment that was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that operators failed to use seat belts when operating equipment such as but not limited to, industrial trucks, loaders, and truck mounted mobile cranes: (a) On 13 July 2004, and at times prior there to, the John Deere Loader, Model Loader, serial number DW644ED518047, articulated loader was operated without the seat belt being used by the operator. (b) On 15 July 2004, and at times prior there to, the Hyster lift truck model H80XL, S/N E005003750L, powered industrial truck (forklift) was operated without the seat belt being used by the operator. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO REQUIRE ALL EMPLOYEES USE SEATBELTS WHEN OPERATING EQUIPMENT WITH SEATBELTS." Note: Abatement certification required for this item.
