Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employee(s) who were
exposed to an unstable elevated load:
(a)On or about 13 July 2004, at the DeLamar Mine and Mill site in Owyhee
County Idaho, the employer failed to ensure that the mill support/jacking
cradles were secured against hazardous motion, in accordance with the
manufacturer's written instructions, while lowering the Semi-Autogenous
Grinding (SAG) Mill onto its trunnion assembly.
(b)On or about 13 July 2004, the employer failed to utilize the engineered
jacking
points on the support/jacking cradle who placed a third hydraulic jack at a
point off a center on the support/jacking cradle without proper blocking
and
bracing.
To abate this violation, the employer must:
(a) Follow the manufacturer's instructions by using sound hardwood or steel
beams as rigid cribbing beneath the cradle and secure the cradle with a
wire
rope over the drum.
(b) When raising or lowering the steel beam/cradle utilize the designed
jacking
points.
Pursuant to 29 CFR 1903.19(d), the employer must abate this hazard within
ten calendar
days and provide documentation that this violation has been abated within
15 working days of
the date received.
