Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling or being crushed: (a)Lot 11: On August 19, 2004, the operator of the Gradall 524, serial #0177256 left the operator position and climbed into the truss system to assist an employee who stepped onto the forks approximately 12 feet to ground level below to move trusses to the structure. Amongst other methods, one feasible and acceptable abatement method to correct this hazard would be to follow the guidelines set forth in ASME B 56.6 2002, Safety Standard for Rough Terrain Forklifts for a safety platform and to keep the operator within 25 feet and visual contact with the controls.
