North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to working from an elevation without fall protection: a)truck and equipment storage yard at 4724 Sweden Rd., for the employee working from the attached elevated platform of the Ford aerial lift truck at a height of 91-inches without fall protection. Reference:29 CFR 1926.501(b)(1) 29 CFR 1910.23(c)(1) ABATEMENT NOTE: Among other methods, feasible and effective means of abatement to correct the hazard are as follows: (1) Install guardrails around the platform. (2) Provide and assure the use of personal fall arrest systems by employees.
