Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm in that employees were exposed to the
hazard of being crushed:
a) On site, rear of the property - The employer allows employees to
operate a stationary compactor without
providing instruction, training or monitoring of their operation of the
unit. The employer did not repair the
safety equipment (micro switch) before using the unit and did not
establish periodic and regular inspections to
ensure safeguards are in safe operating condition and maintaining these
reports. The key for operating this unit
is left in the controls so that anyone can operate it, on or about 8/26/03.
One means if feasible abatement, among others, is to follow the
manufacturer's requirements as set forth in
American National Standards Institute (ANSI) Standard Z245.1-1984,
American National Standard for Refuse
Collecting and Compacting Equipment - Safety Requirements, section 6.2 and
section
8 of this standard for
employer responsibility for stationary compactors and stationary
compactors safeguards and features.s
