Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: falls of in excess of 10 feet due to failure of a single point suspended scaffold in that: a) On or about March 27,2003 a single point suspended scaffold was utilized without assurance by employees utilizing the scaffold that erection/rigging of the scaffold was completed. A feasible and acceptable method of abating the condition would be to ensure that communication exists between employees, that the employees know that the scaffold is secure prior to applying tension and raising the scaffolding by communicating in accordance with ANSI/IWCA I-14.1-2001 for Window Cleaning Safety.g
