Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:

exposed to: The Employer did not insure that employees vision was not
impeded when driving forward
in a dozer. The operator was unable to see another employee in his path
because of the built up of debris/
waste material. Two dozer operator were moving/ pushing waste farad to a
designated location. The lead
operator stopped his dozer, dismounted and went behind the dozer. The
dozer operator that was behind
was unable to see the dozer or the operator in his path and ran into the
operator and the dozer crushing
the employee. The blade of the dozer was 9.4 feet, the debris exceeded 12
feet and obstructed the line
of sight of the operator.
Among other methods, one Feasible and acceptable abatement method to
correct the hazard
is to insure that the employees follow the manufacture's operators
instruction. It clearly states
to prevent injury and death, make sure the area around the machine is
clear of personnel and
obstruction before moving.The operator manual stated not to follow any
other vehicle too closely
and not to move your vehicle if you don't know where your helper is.
