Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)the recognized hazards of being caught-in/struck-by industrial motor vehicles when the operators' view is obstructed during loading and unloading operations of equipment. Among other methods, one means is to institute a program which includes the use of a ground man (ground guide) to assist the operator in spotting during the loading and unloading of equipment such as, but not limited to, Grandall Material Handlers as specified by Chapters 3, 10, and 12 of the National Safety Council Accident Prevention Handbook, 10th Edition.
