Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling when climbing in and out of an Upright SL20 scissor lift while it was elevated. Among other methods, a feasible and acceptable abatement method is to comply with the National Standards Institute (ANSI) A92.6 1999 Self-Propelled Elevating Work Platforms which require personnel maintain a firm footing on the platform floor while working thereon.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling when the access gates or openings were not closed with the safety chain or another acceptable manner on the Upright SL20 scissor lift while it was elevated and during descent. Among other methods, a feasible and acceptable abatement method is to comply with the National Standards Institute (ANSI) A92.6 1999 Self-Propelled Elevating Work Platforms which requires access gates or openings to be closed and per manufacturers instructions.
