Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazards of being ejected from and crushed by/caught between when using powered industrial trucks (PIT's) without ensuring that employees utilize personnel restraining devices. On or about the date of 11/15/04, at the O'Brien Wire Products of Texas Inc worksite, employees used electrical powered industrial trucks to distribute, load and unload material without using the personal restraining devices (seat belts) supplied/installed by the manufacturer, such as but not limited to Clark, Toyota, Hyster, Crown, and Yale. Among other methods, one feasible and acceptable abatement method is to: (a)Install/reinstall operator restraining devices (seat belts) to stabilize and protect the operator in the event of a rollover. (b) train/retrain employees in accordance with ASME/ANSI B56.1 - 2000, consensus Safety Standards for Powered Industrial Trucks. (c) ensure that employees utilize the seat belts. Disclaimers: You are not limited to the abatement methods described above. The methods explained are general and may not be effective in all cases. The employer is responsible for selecting and arrying out an appropriate abatement method.
