North Carolina General Statue 95-129(1)of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being struck by/caught by the vehicle frame in the event of an accident/vehicle up-set. The operator of the 2800 lb., Toyota forklift, s/n 60120, was not wearing the installed seat belts while operating the vehicle in the manufacturing area of the plant. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to enforce the use of the installed seat belts by the operators of the company's forklifts. (Reference: ASME/ANSI B56.1a-1989, Addenda to ASME/ANSI B56.1-1988, and ASME B56.1-1993 -Safety Standard for Low Lift and High Lift Trucks.)
