North Carolina General Statute 95-129(1) of the Occupational
Safety and Health Act of North Carolina:  The employer did not
furnish to each of his employees conditions of employment and a
place of employment which were free from recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees were exposed to:
a)being struck by the bucket of a Caterpillar backhoe:
the employer did not ensure that employees at the
excavation work site located on Tower Road in
Thomasville, North Carolina, followed appropriate
procedures to ensure that the 1200 pound bucket on a
Caterpillar 330 BL backhoe, Ser #6DRO3175, was properly
and securely attached and would not become detached,
exposing employees working near and/or under the bucket
to being struck or pinned by the bucket should it
separate from the boom and fall.
One feasible and acceptable abatement method(s) to correct
this hazard include ensuring that the operator follow
appropriate procedures, such as outlined in the
manufacturers operation and procedural manual, to ensure
that the bucket on the Caterpillar 330 BL backhoe, Ser
#6DRO03175, was properly attached and would not become
detached; and, that employee working in the vicinity of the
backhoe stay clear of the areas near and/or underneath of
any raised load or equipment.
