North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)asphyxiation due to lack of oxygen or exposure to organic vapors. Employees required to enter sewer manholes multiple times 6-26 thru 7-8 of 2003 without atmospheric testing, without safety harness /lifeline for emergency rescue and without effective confined space entry program. [Reference 29 CFR 1910.146] Among other methods, one feasible and acceptable abatement method to correct this hazard is to implement effective permit required confined space entry program.
