North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being caught between the forklifts frame and the floor or ground in the event of an upset or turn over. An employee was operating the Mitsubishi LPG forklift, serial # AF82C-01680, model #FGC20K, 4000 lb capacity without wearing a seat belt. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard was to require the operator to wear the seat belt while operating the forklift.
