North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees in that employees were exposed to:
a)the hazard of being pinned beneath the Yale Model GP060, serial P296656
industrial truck
or struck by the overhead protection due to the lack of use of the seat
belts provided on the
vehicle by employees.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be
the training of employees and the use of disciplinary action to assure
employees used the seat belts to
prevent their falling from or being thrown from the vehicle.
