North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)the hazard of being struck by and pinned beneath the Caterpillar, Model F30, Serial 5DB2740, Type E industrial truck due to the absence of an active operator restraint system or seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard would be the installation of the seat belt retrofit kit made available by the powered industrial truck manufacturer or distributer and requiring the operator to wear same.
