North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees in that employees were exposed to:
a)being caught between the frame of the Komatsu forklift, model #FG 25T-8,
serial #038394,
and the concrete floor; the rollover protection system (ROPS) equipped
forklift was not
equipped with a set of seat belts at the operator's station which exposed
the operator to being
caught between/crushed by the frame and the floor, should the forklift be
overturned; a mixing
employee was observed operating the forklift on the loading dock and in
the mixing room on
January 21, 2004; employees used the forklift daily to move such items as
300-gallon
containers of resin mixtures.
*Abatement Note:  A feasible and acceptable method to abate the hazard
would
be to install a set of
seat belts at the operator's position and enforce the use of the seat
belts when the vehicle is in
operation.
