General-duty citation text
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)plant wide - being caught between the frame of the Model FG20, TCM forklift, s/n 55404821, and the concrete floor. The ROPS equipped forklift was not equipped with a set of seat belts at the operator's station which exposed the operator to be caught between the frame and floor should the forklift be up-set. Among other methods, one feasible and acceptable abatement method to correct this hazard was to install a set of seat belts at the operator's position and enforce the use of the seat belts when the vehicle was in operation.
