North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)within the facility - the employer did not ensure the Kalmar forktruck operator was utilizing the seat belt. NOTE: Among other methods, the feasible and acceptable method to abate this hazard is to utilize the Kalmar forktruck in accordance with the manufacturer's recommendations.
