A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that the employer did not ensure that powered industrial trucks were equipped with operator restraint devices, including seat belts, to be used during the operation of such trucks in accordance with the American National Standards Institute (ANSI) B56.1, consensus Safety Standards for Powered Industrial Trucks, and the American Society for Mechanical Engineers (ASME) B56.1-2000, consensus Safety Standards for Low Lift and High Lift Industrial Trucks, to protect the operator in the event of a rollover: a) Garden Center: The employer did not ensure that a Komatsu Forklift, FG20C-11, Serial Number 4467777-A, was equipped with an operator restraint device (i.e., seat belt) to stabilize and protect the operator in the event of a rollover.
