Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a.At the site where sewage work was being performed, the bucket of the New
Holland 555E Backhoe/Loader was used as a personnel carrier. Employee was
exposed to a fall hazard.
Among other methods, feasible and acceptable abatement methods to correct
this
include, but are not limited to the following:
a.Follow the EMI (Equipment Manufacturers Institute) protocol and
safe operating procedure for operators and mechanics which states:
Never use bucket for a work platform or personnel carrier.l
