Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a. At 60 East Spring St., Columbus, Ohio, 43215, where the Linkbelt track hoe/excavator was being used to place waste brick, mortar and concrete in a semi truck trailer, protection or barriers were not placed behind the track hoe/excavator to warn employees in or near the swing radius of the counterweight, thus exposing employees to a struck-by hazard. Among other methods, a feasible and acceptable method to correct this hazard would be to erect a barrier around the swing radius of the track hoe/excavator to prevent employees from getting in the danger zone.r
