Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a.On the site where sewer pipe was rolled behind the swing radius of the Komatsu Excavator, protection was not placed around the swing radius thereby exposing employees to a struck-by hazard. Among other methods, a feasible method to correct the hazard would be to erect a barrier around the swing radius of the excavator to prevent employees from entering the danger zone.
