Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by the excavator: a) Between Buildings 135 - 139: The employee was struck by the excavator on September 12, 2003. Among other methods, feasible and acceptable abatement method to correct this hazard is to: (1) To train employees to never position themselves in the swing radius zone where they may be struck by the bucket while it is being lifted, moved, or swung. (2) Provide training to the operators to confirm the location of employees who are working with them or bystanders prior to moving, swinging, or operating the excavator. a) Between Buildings 135 - 139: The employee was struck by the excavator on September 12, 2003.
