Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an impalement hazard: a)South Exterior: A worker was exposed to an impalement hazard while working upon open structural steel framing with exposed rebar supporting a temporary barricade below, on or about May 05, 2004. NOTE: Among other methods, feasible and acceptable abatement methods to correct this hazard are: 1.Use an alternative support for a temporary barricade such as framing lumber. 2.Use accepted rebar protective covers.
