Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fire and deflagration hazard due to ignition of organic peroxide formulations: a)BPO Storage Area: Atofina Luperox A95 (a Class I organic peroxide formulation) and Akzo Nobel Perkadox PM-50S-PS (a Class III organic peroxide formulation) was stored in an Amerikooler 6X6 walk-in refrigerator that did not have Class I Group D Division I rated interior electrical equipment and was not designed to be blast resistant to 432 psf, on or about 11/08/2004. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to obtain a refrigerated storage unit that is manufactured to meet all the requirements of NFPA 432-2002: Storage of Organic Peroxide Formulations.
