General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a serious fall hazard: a) Throughout the Warehouse - Employees operate order picker type powered industrial trucks with the operator being elevated with the controls. The operators, working on the platforms at elevations of up to 13 feet, "pick" products, doors and windows of various sizes and weights, from storage racks and load them onto the order pickers. No fall protection had been provided to , or was being utilized by, the operators during these tasks on or about 4/1/04. ABATEMENT NOTE: One feasible and acceptable method to correct the hazard is to follow applicable requirements set forth in American Society of Mechanical Engineer's (ASME) Safety Standard for Low Lift and High Lift Trucks B56.1-2000 whenever a powered industrial truck is used to elevate personnel. A suitable means of fall protection must be provided for employees while they operate the order picker trucks. No abatement certification or documentation required.
