North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a metal barrier gate: a)facility, entrance area by guard house - where a metal barrier gate had been damaged on one end and was not securely held in place by the rollers, creating the potential of the gate falling on employees. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO REPLACE THE DAMAGED SECTION OF THE GATE.ON
