North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The employer
did not furnish each of his employees conditions of employment and a place
of employment free from recognized
hazards that were causing or likely to cause death or serious physical
harm
to employees in that employees were
exposed to falling cargo:
Ref:  Manufactures requirements for ANTHONY LIFTGATES, INC. Installation
and operation maintenance and
troubleshooting for medium Railtrac hydraulic liftgates.
a)facility - employees operating a  2500 pound rated lift gate model AR
2500 had not received training in
the safe operation and loading of the lift gate.
facility - employees operating a 2500 pound rated lift gate model AR2500
and the employer did not
conduct monthly and simi-annual inspections of the lift.
facility - employees operating a 2500 pound rated lift gate model AR 2500
and employees were allowed
to ride the gate.
Among other methods, one feasible and acceptable abatement method would be
to conduct training for
all drivers and operators of the lift gates and conduct simi annual and
monthly inspections.
