North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)establishment - the employers OSHA 200/300 logs for the years 2000, 2001 and 2002 reveal that 55of all injuries occurring in the workplace were the result of strains and sprains. These same injuries accounted for 70of all restricted workdays and 42of all lost workdays, but the employer had not provided any type of lifting and/or back safety training and/or beneficial education or physical training/conditioning to assist in preventing injuries. "Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide a comprehensive lifting safety and education program, or provide back injury prevention personal protective equipment and training, or provide regular physical exercise/conditioning training."
