General-duty citation text
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)worksite - employees were exposed to falls from an elevated position and/or crushing by collapsing building materials. Steel plate joined wooden roof trusses were installed on the wall headers with ten penny nails, but were not braced either internally or externally against collapsing. The Truss Plate Institute installation instructions for the type truss being installed, (HIB-91), which the employer had on site, states in the notice block of Frame two, "DANGER: Ground bracing required for all installations", and in frame six, "DANGER: Under no circumstances should construction loads of any description be placed on unbraced trusses". The employer required his employees to work 12 feet above the ground installing roof sheathing on a roof system that was not braced against collapse. "Among other methods, one feasible and acceptable abatement method to correct this hazard is to install ground internal and/or external bracing to the roof trusses according to the manufacturers instructions."
