North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical
harm to employees in that
employees were exposed to a crushing hazard.  The exposure was probable in
that employee was exposed to hazard
of falling limb cause by positioning himself beneath limb and making
overhead cut with chainsaw.
a)     worksite - an automotive lift that, which did not have a
manufacture installed safety catch br installed (
approximately 40 years old ) was operated uder capicity or near capicity
load while a leak occured in the hydraulic
over air system that was used to operate the lift. The lift was shored up
with up 4 " x 4 " wooden post to prevent the
lift and load from falling on the employee working under and near the lift.
a)Site - On or about 17 May 2003 an employee was using chainsaw, Shindawa,
model 488, to  cut
overhead limb, resulting in the limb swinging down and striking the
employee.
In the alternative: 29 CFR 1910.266(e)(2)(xi): Chain saws were used to cut
directly overhead:
