North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: (Reference: American Society of Mechanical Engineers ASME B30.16-1998) a)Facility - employees were allowed to lift truck bodies weighing as much as 5000 pounds using a combination of mechanical (hand chain) hoists and electrical (wire rope) and/or chain hoists that (all) had not been subjected to frequent (monthly) or periodic (yearly) inspections. (Reference : ASME B30.16-1998, paragraph 16-2.1.1) b)Facility - employees were allowed to lift truck bodies weighing as much as 5000 pounds using a combination of mechanical (hand chain) hoists and electrical (wire rope) and/or chain hoists that were (all) missing the safety latch from the load hooks. (Reference: ASME B30.16-1998, paragraph 16-1.2.9 c)Facility - employees were allowed to lift truck bodies weighing as much as 5000 pounds using a combination of mechanical (hand chain) hoists and electrical (wire rope) and/or chain hoists with unknown capacities (none of the hoist capacities could be read and/or determined from the ground). (Reference: ASME B30.16-1998, paragraph 16-1.1.1) d)Facility - employees were allowed to lift truck bodies weighing as much as 5000 pounds using a combination of mechanical (hand chain) hoists and electrical (wire rope) and/or chain hoists with none of the required warnings posted.(Reference: ASME B30.16-1998, paragraph 16-1.1.4) Among other methods, some feasible and acceptable abatement methods to correct this hazard would be to institute a regular inspection program to identify and correct hoist deficiencies as they occur and to remove hoists from service as needed.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: (Reference: American National Standard ANSI/ASC Z49.1-1988) a)Facility - employees were allowed to perform arc welding inside a five foot diameter stainless steel tank without the benefit of personal protective equipment (PPE) or protective devices to prevent accidental contact with the positive lead of the welder, and simultaneous contact with the tank, which would act as ground, and created the potential of electrocution. Additional factors creating an electrocution probability was extremely hot conditions inside the tank, ideal for profuse perspiration, as well as the presence of a shallow layer of water in the bottom of the tank. (Reference: ANSI/ASC Z49.1-1988, paragraph 11.2.2 and 11.4.9.2; NIOSH publication 77-131; American Welding Society Pamphlet dated 1988, titled ARC Welding Safety; American Federation of State, County and Municipal Employees (AFL-CIO) Fact Sheet, Health and Safety: Welding Hazards) Among other methods, some feasible and acceptable abatement methods to correct this hazard would be to use mechanical ventilation (to cool the area and evaporate moisture, in addition to PPE and protective equipment such as rubber gloves, and a rubber mat on which to stand/kneel.
