North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: (Reference: American Society of Mechanical Engineers ASME B30.16-1998) a)Facility, Medium Parts Lamination, and hoists throughout the facility - employees were allowed to lift boat parts weighing as much as 770 pounds (averaging 400-600 pounds) using an electrical (wire rope) hoist that had not been subjected to frequent (monthly) or periodic (yearly) inspections. (Reference : ASME B30.16-1998, paragraph 16-2.1.1) b)Facility, Deck Lamination, and hoists throughout the facility - employees were allowed to lift boat deck assemblies weighing as much as 7200 pounds using electrical (wire rope) hoists with unknown capacities (none of the hoist capacities could be read and/or determined from the ground). (Reference: ASME B30.16-1998, paragraph 16-1.1.1) c)Facility, Deck Lamination, and hoists throughout the facility - employees were allowed to lift boat deck assemblies weighing as much as 7200 pounds using electrical (wire rope) hoists that had none of the required information concerning operating procedures posted. (Reference: ASME B30.16-1998, paragraph 16-1.1.4 (b) 1-8 and (c)) d)Facility, Deck Lamination, and hoists throughout the facility - employees were allowed to lift boat deck assemblies weighing as much as 7200 pounds using electrical (wire rope) hoists that had controls that were not marked to indicate the direction of resultant motion. (Reference: ASME B30.16-1998, paragraph 16-1.1.2) Among other methods, some feasible and acceptable abatement methods to correct this hazard would be to institute a regular inspection program to identify and correct hoist deficiencies as they occur and to remove hoists from service as needed.
